Contracts are the essence of people transactions. Every day we all enter into contracts with people even without noticing. Contracts could be written legal instruments or could be orally concluded. Even in the simplest situations, we enter into contracts, for example, when someone goes to fill up his/her car with gas at the gas station, that person enters into a contractual relationship with the gas station, and therefore both parties to the contract assume legal obligations and duties without saying a word. But what are the main elements that formed such a contract even without saying one word, how could the parties conclude a binding enforceable contract by their actions and conducts. The way to conclude a valid enforceable contract relies predominantly on the elements established thereto which are mainly the legal intention, consideration, offer, and acceptance.
Imagine that in every sector and activity we go through our career and life governed by a certain set of rules and provisions that help us to avoid any dispute that might arise between people in the future. Those set of rules are the terms and conditions of a contract. It is of great importance to be able to construe this legal relationship, terms, and conditions even to go beyond that and to be able to draft it legally and correctly. Each party to a contract assumes duties and obligations, and the way forward to carry them out depends on our correct understanding of how certain clauses of the contract are drafted.
